Sexual Violence : Standard of Proof
As with other cases, sexual misconduct cases are decided if the "preponderance of the evidence" ("more likely than not") indicates misconduct occurred. It is a much lower standard than the one used in criminal cases, which is the "beyond a reasonable doubt" standard.
